I like this because it establishes something important without making a big production out of it: “Service” means the website. That’s essentially how Kyle structures his definition.

This is our important addition. Kyle doesn’t appear to have anything comparable because his generic template wasn’t written around a quote-generation website. I think ours needs it—but notice that we still aren’t spelling out the mechanics of the lead-generation business.
Website Information
Information provided on the Website is for general informational purposes. While we strive to provide accurate and useful information, auto glass repair and replacement requirements can vary depending on the vehicle, type and location of damage, and other circumstances.
Information on the Website should not be relied upon as a determination that a particular windshield or other vehicle glass can be repaired or must be replaced. Specific service needs should be evaluated based on the vehicle and circumstances involved.
I think this is another worthwhile addition because we’ve written quite a lot of educational content about when windshields may be repaired versus replaced.

Kyle has essentially the same type of third-party-link protection in his Terms.

The Website and its content are provided on an “AS IS” and “AS AVAILABLE” basis without warranties of any kind, to the fullest extent permitted by applicable law.
We do not warrant that the Website will always be available, uninterrupted, error-free, or free from harmful components, or that all information provided through the Website will be complete, current, or error-free.
Kyle’s disclaimer is much longer and more legalistic than this. I don’t think we gain anything by reproducing that giant paragraph. I’d rather have a provision ordinary people can actually understand.
Limitation of Liability
To the fullest extent permitted by applicable law, St. Louis Auto Glass Pros will not be liable for indirect, incidental, special, consequential, or similar damages arising from or related to your use of, or inability to use, the Website or information provided through the Website.
Nothing in these Terms and Conditions excludes or limits liability that cannot lawfully be excluded or limited.
Kyle also includes limitation-of-liability language, including a much more specific monetary limitation. I would not borrow his $100 limitation without legal advice. There’s no reason to assume a provision generated for his Louisiana site is appropriate for ours.
Insurance Information
Any information on the Website concerning automobile insurance or insurance coverage is provided for general informational purposes only.
Insurance coverage, deductibles, claim requirements, and benefits vary by insurer and policy. Questions regarding your individual coverage should be directed to your insurance company or insurance representative.
This section is ours, not Kyle’s. I think we need it because both service pages discuss insurance.
Governing Law
These Terms and Conditions and your use of the Website will be governed by applicable laws of the United States and the State of Missouri, without regard to conflict-of-law principles.
Kyle’s Terms contain a governing-law provision, although his template identifies Louisiana.
I’d flag this particular provision for attorney review later because jurisdiction and governing-law clauses are legal questions rather than simply website-copy decisions.
Dispute Resolution
If you have a concern or dispute regarding the Website, please contact us first so that we may attempt to resolve the matter informally.
Kyle has essentially this same provision.
Severability
If any provision of these Terms and Conditions is determined to be invalid or unenforceable, the remaining provisions will continue in full force and effect to the extent permitted by law.
Waiver
Failure to enforce any provision of these Terms and Conditions will not constitute a waiver of that provision or the right to enforce it in the future.
Those two provisions follow the same general concepts Kyle uses.
Changes to These Terms and Conditions
We may update these Terms and Conditions periodically. Changes will be posted on this page along with an updated “Last Updated” date.
Your continued use of the Website following the posting of revised Terms and Conditions constitutes your acceptance of those changes.
Kyle also includes a modification provision, although his promises “reasonable efforts” to provide 30 days’ notice of material revisions. I don’t see a reason for us to voluntarily promise that.
